“You Are Perverting Justice”, Plaintiff Tells Adamawa Attorney General.

A complianant in criminal case against Suleiman Umar Jabu before chief magistrate court 2 in Yola has called on the Attorney General and Commissioner of Justice, Afraimu Kandamwe Jingi not to pervert justice.

Vandimiyi Mohammed Usman, the complainant in the criminal case said the call became necessary because the Attorney General and Commissioner of Justice had written to the court to stop further hearing of the case and discharge the defendant immediately.

The Defendant Suleiman Jabu who is a younger brother to the present commissioner of local government in Adamawa state was charged to chief magistrate court 2 in Yola on a 3 count charge.

In count 1 the defendant was charged for cheating contractor to sec. 313 other the panel code law of Adamawa state 2018.

Count 2 the charge was a criminal breach of thust contratry to 303 of Penelope code laws of Adamawa state 2018. And in count3 the comlinat was charged for misappropriation contract to sec.299 of the penelcode law of Adamawa state 2018.

According the the fact of the case, before the court, states that the defendant on the 8th of February, 2019, collected the sun of N41m for the purchase of two trailer truck at N15m each and another N11m for the purchase of petroleum products.

That after about a year the defendant refused to buy the trucks nither did he returned the money.

But paid the sum of N17m , having a balance of N24m.

Accoding to the complainant, ” things became worst when the court granted bail to the defendant in the sum of N5m but he could not meet up with the bail condition.

Corrobating the complainant Barr. Abubakar Mohammed, a constitutional lawyer said the actions of the Attorney General is misuse of executive power.

Noting that the dismissal of the case by the Attorney General and Commissioner of Justice is a grand design to pervert justice and does not conform with section 211(3) of the Constitution of the Federal Republic of Nigeria 1999 as amended.

Section 211(1)(c) of the Nigerian Constitution 1999 as amended only permit such an action when it is in the interest of the public and it will not pervert the cause of justice..

The Attorney General and Commissioner of Justice of Adamawa state, in a letter Dated 5th November, 2020 addressed to the Chief Magistrate Court 2

titled ” NOLLE PROSEQUI.’

Re: Vandimiyi Mohammed Usman Versus Sulieman Umar Jabu.

“By the power conferred on me by section 211(1)(c) of the Constitution of the Federal Republic of Nigeria 1999 as amended, I hereby enter a NOLLE PROSEQUI in the above referred case.

The letter which was made available to our correspondent and signed by Attorney General and Commissioner of Justice further read that ” by this present, you are directed to forthwith terminate the proceedings in the criminal case and with immediate effect discharge the defendant”

The Chief Magistrate Court presided over Magistrate Court 2 had since complyed with the directive and also released the defendant who was unable to perfect the bail conditions.

Effort to reached the Attorney General and Commissioner of Justice failed, he was not in his office and phone calls and text message was not returned as at the time of filling this report.
