Delta State High Court orders arrest of a popular Asaba base land Dealer Lucky Favour Abuah aka Bullet, His Company Henric Empire Garden Ltd and 4 others

Delta State High Court presided over by Hon. Justice H.O. Akpotohwo sitting in Ibusa Delta State has issued a bench warrant for an immediate arrest of a popular Asaba base land dealer Chief Lucky Favour Abuah aka Bullet, his company Henric empire garden Ltd and other four accused persons arraigned with Abuah aka bullet in a criminal charge of forceful acquisition of land belonging to a group of landlords operating as Fountain City Landlords Asaba, Delta State brought against Abuah and others by the Inspector General of Police, Kayode Egbetokun.

According to the Seven count charges filed by the inspector general of police (IGP) against Chief Lucky Favour Abuah Aka bullet, his company Henric empire garden Ltd and others which was read in the open court. Chief Abuah, his company Henric empire garden Ltd and others were charged with breach of peace, obtaining money by force, criminal forceful entry, obtaining money by trick, dispossession of lands from its true owners etc all criminal offences which are punishable under the criminal laws of Delta State.

Addressing the court after the seven count charges was read in the open court, Bar. M.F. Anthony the police lawyer representing the inspector general of police told the court that he was surprised for not seeing the accused and their lawyers in court despite been adequately served to appear. He reminded the court that the defendants has been playing all manners of
tricks to evade the court sumon which necessitated the court to serve them through subsistuted mean but that they did not appear in court. He informed the court that every relevant papers has been filled and charges amended for the prosecution to commence their case.

While submitting that there is the need for the court to issue a bench warrant for the arrest of accused persons in order to compel them to come to the court to face trial, he referred the court to section 273 (1) of Delta state criminal justice system and the decided case of attorney general of Nigeria vs. Yahaya Bello and urged the court to issue a bench warrant for the arrest of the defendants.

Ruling on the case after listening to the submission of the learned police counsel, Hon. Justice H.O. Akpotohwo ordered the arrest of Chief Lucky favour Abuah aka bullet his company Henric empire garden Ltd who are the 6th and 5th accused persons in the criminal charge sheet as well as other four accused persons. The erudite judge further ordered that the accused persons when and wherever seen should be apprehended and kept in police custody till the next sitting of the court and adjourned the case to January 15th, 2026 for pleadings.

Newsmen gathered from sources closed to Ibusa Community leadership the community housing the disputed land that the Fountain City Landlord first bought the land with payment receipt issued to them but an inner source who don’t want his name to be mentioned alleged that the problem started sometimes in 2022 when a company Henric empire garden Ltd owned by one of the accused Chief Lucky Favour Abuah aka bullet came into the land with a bulldozer claiming that they are there on government instruction and destroyed every property on the land and later on sold the place to an estate company PWAN PLUS business concerns owned by one Julius Ayademi.
