Court grants grandmother custody of 3 grandchildren

A Grade I Area Court in Kubwa, Abuja, has granted a grandmother, Zainab Abdulsalam custody of her three grandchildren, based on child custody rights in Sharia law.

Delivering ruling, the judge, Muhammad Adamu held that Islamically, rights of custody is solely that of the mother first until she contracts another marriage and once this is done, she has lost the right.

The respondent, Muwadda Hamza had remarried after her marriage to the plaintiff, Mohammed Fika was dissolved in April, 2018.

Adamu, however, ordered Fika to give the respondent’s mother, Abdulsalam, N40, 000 monthly for feeding of the three children and enroll them in the school of his choice and pay the fees.

He also ruled that Fika should also be responsible for the health care of the children and pay N50, 000 yearly for rent to Abdulsalam.

According to Adamu, the plaintiff can alternatively rent a befitting place if not satisfied with the custodian’s environment.

The judge ordered that first, third term holidays and Eid-el Kabir should be spent with the father while second term holiday and Eid-al-Fitr spent with their mother.

He said that the plaintiff should have access to his children provided notice to the custodian was given.

Earlier, Fika had approached the court seeking custody of his children ages, 10, 7 and 5, saying that the respondent had denied him access to them, only at her own will.

He said that he did not want another man to raise his children considering the fact that the respondent had contracted another marriage.

The respondent, however, urged the court to dismiss the plaintiff’s application, saying that she had fed and catered to the wellbeing of the children for the past four years.

She urged the court to grant custody to her or her mother, whom is alive, healthy, Muslimah and capable of maintaining and disciplining the children. (NAN)
