The Respondent in the matter before the Legal Practitioners Discriminatory Committee(LPDC) , and in respect with; BB/ LPDC /274/ 2020, U.S. Ekpo Esq while countering the evidence attached to the affidavit of facts sworn by Mr. Chukwunenye Nweke said that he, U. S. Ekpo Esq was not in the magistrate court ,Awka when His Worship Mike initiated the proceeding that led to the grant of the court order, marked Exhibit R by Mr. Nweke.

But in a court paper dated, 02/08/2019 and signed by His Worship Mike Anyadiegwu and other Magistrate Court, Awka officials, U. S. Ekpo Esq was present in court on the 02 /08/2019, when Mr. Nweke through his lawyer, S. I. Obinwa filed a motion leading to the grant of Exhibit R( court order).

And according to Exhibit R, the prosecutor, U. S. Ekpo Esq did not oppose the application filed by the defence.

Nevertheless, U. S. Ekpo Esq made the affirmation that he was not in court or a party to the court proceeding that led to the grant of the court order to absolve himself from the allegation of lack of respect for rule of law , abuse of legal procedure and human rights abuses Mr. Nweke accused him, but the adduced court paper shows that U. S. Ekpo was indeed in court and part of the proceeding that led to the grant of the court order dated, 16th October, 2019 and signed by Hisworship.
