A Federal High Court sitting in Abuja has adjourned the hearing of the Originating Summons challenging the continous stay of Mr. Ibrahim Magu at the EFCC as its acting chairman to 10th October, 2017. This followed the application for adjournment brought by the Senate who was sued as the 1st Defendant in the suit. The Senate, through its Counsel, Galadima, Esq., sought for adjournment to enable it file its proceeses.

It would be recalled that an Abuja based Human Rights Activist, Barrister Johnmary Jideobi, had approached the Federal High Court sitting in Abuja with the question whether upon a dispassionate of Section 2(3) of the EFCC Act, read alongside Section 11 of the Interpretation Act the acting chairmanship tenure of Mr. Ibrahim Mustapha Magu has not ended especially in the light of the rejection of his nomination by the President as the substantive chairman of the Commission by the Senate of the Federal Republic of Nigeria. The Plaintiff sought for an order directing forthwith Mr. Ibrahim Mustapha Magu to vacate the office of the acting chairman of the EFCC.
