www.odogwublog.com reports that Anambra PDP Chairman , Ken Emeakayi has raised another alarm over threat to his life by no small personality but Governor of the state, Chief Willie Obiano.
Efforts by www.odogwublog.com to get responses from the Governor himself when his Commissioner for Information, Hon Tony Nnacheta , (he never picks my calls no matter the circumstance), SSA Media James Eze and SSA Image Paul Nwosu did not respond to their phone calls proved abortive.

ABUSE OF POWERS AND OATH OF ALLEGIANCE, AND OATH OF OFFICE OF GOVERNOR OF ANAMBRA STATE.

In the exercise of our civic rights and obligation as guaranteed by the Constitution of the Federal Republic of Nigeria 1999 (as amended), we addressed a letter to the Speaker of the Anambra State House of Assembly, dated February 9, 2017, requesting the House under the Rules and Privileges of Public Petitions, to investigate allegations of grave violation of the 1999 Constitution, the Breaches of the Peace and Unlawful Assemblies Prohibition Law of Anambra State 2015, the Local
Government Law of Anambra State 1999 (as amended), respectively, brought against, Governor Chief Willie Obiano and the Government of Anambra State.

Similarly, in another letter dated February 13, 20f7, we invited the House of Assembly of Anambra State to the performance of her statutory public duty by ensuring strict adherence to the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended) particularly Section 190.(2), in the administration and management of the day to day running of the Government of Anambra State.
Furthermore, in a letter dated February 20, 2017, we requested our supposed elected representatives in the House of Assembly of Anambra State to use their good office to prevent the unlawful plans by the Governor Willie Obiano led Government of Anambra State, to appoint caretaker/transition committees and/or liaison officers, in whatsoever named called, to manage the affairs including finances of the 21 local government council areas in Anambra State.

Unfortunately, rather than to investigate our petitions on its merits, the Anambra State House of Assembly through the member representing Onitsha North Constituency, Hon. Chugbo Enwezor, took robust public engagement of elected representatives and participatory constitutional democracy to an unimaginable height by resorting to pettiness and names calling. Please see page 16 of Vanguard newspaper of Wednesday February 22, 2017.

Likewise, political appointees and agents of the Government of Anambra State, including, Prince Oliver Okpala, Mr. Tony Ifeanya, Hon. Prince Casmir Ajulu, Emeka Nzekwe, and others, have taking their turns in the print and electronic media and in the various networks of the social media, to castigate, malign, abuse, and call me all kinds of unprintable names.

The climax was when in a telephone conversation on Thursday February 23, 2017, the Governor of Anambra State, Chief Willie Obiano, directly by himself, threatened to kill me, and also to make me to feel what His Excellency called the wrath of Aguleri.

In addition to calling me unprintable names, His Excellency Governor Willie Obiano, the Anambra State House of Assembly, the All Progressive Grand Alliance and their agents, have invested so much energy and precious government time and resources in asking which faction of the POP KEN EMEAKAYI belongs. Assuming but without conceding that KEN EMEAKAYI is not the Chairman of POP in Anambra State, will that in any way exonerate anyone that has offended the law from been punished accordingly.
Again, assuming but without conceding that KEN EMEAKAYI is a 'criminal' as he is being branded by the Governor and his agents, is there any law which will preclude a "CRIMINAL" from an act of patriotism. Would the long arms of the law neglect to catch up with, and its hammer refuse and fail to descend and fell heavily on the head of “HOLY MEN” caught in the act of illegality and lawlessness just because the man who blew the whistle is a 'criminal'.
However, KEN EMEAKAYl is the current and serving Chairman of the Peoples Democratic Party in Anambra State, duly elected into office by the State Congress held at Marble Arch Hotel Awka, on May 10, 2016, conducted by the Congress Electoral Committee led by Hon, Ladi Edun, and appointed by the National Executive Committee of our great Party. KEN EMEAKAYI is the Chief Executive Officer of Peoples Democratic Party in Anambra State, in line with the PDP Constitution 2012 {as amended). You may wish to direct further enquiries on who is the PDP Chairman in Anambra State, to the INEC.

Without appearing to be disrespectful and also without the slightest sign of being immodest and/or trying to test the almighty authority and power of life and death vested in His Excellency, Chief Willie Obiano, the Governor of Anambra State, it may be pragmatic to humbly request Your Excellency's consideration of the following questions that has been begging for answers:

1.    WHAT DID THE CONSTITUTION SAY:
1.0.1    TEMPORARY ABSENCE OF THE GOVERNOR:
1.0.2    It is the express and unambiguous provisions of Section 190.(1) of Constitution of the Federal Republic of Nigeria 1999 (as amended) that; ''Whenever the Governor is proceeding on vacation or is otherwise unable to discharge the functions of his office, he shall transmit a written declaration to the Speaker of the House of Assembly to that effect, and until he transmits to the Speaker of the House of Assembly a written declaration to the contrary, the Deputy Governor shall perform the functions of the Governor as Acting Governor."

2.     QUESTIONS:
2.01.    Did the Governor of Anambra State, His Excellency, Chief Willie Obiano, transmit any written declaration to the Speaker of the Anamhra State House of Assembly before proceeding on vacation in January 2017?

2.02.    Is it within the discretional powers of the Governor of Anambra State, His Excellency, Chief Willie Obiano, to decide whether or not the Deputy Governor shall perform the functions of the office   of the   Governor of Anambra   State   as the   Acting Governor during his temporal absence and/or whenever the Governor proceeds on vacation?

2.03.    Did the Deputy Governor of Anambra State, His Excellency, Dr. Nkem Okeke, perform the functions of the office of the Governor as the Acting Governor of Anambra State during the period Governor Willie Obiano was on vacation in January 2017?


3.    AGAIN, WHAT DID THE CONSTITUTION SAY:
3.01.    TEMPORARY ABSENCE OF THE GOVERNOR:

3.02.    It is also the express and unambiguous provisions of Section 190.(2) of Constitution of the Federal Republic of Nigeria 1999 (as amended) that; "In the event that the Governor is unable or fails to transmit the written declaration mentioned in subsection (1) of this section within 21 days, the House of Assembly shall, by a resolution made by a simple majority of the vote of the House, mandate the Deputy Governor to perform the functions of the office of the Governor as Acting Governor, until the Governor transmits a letter to the Speaker that he is now available to resume his functions as Governor."
4.    QUESTIONS:

4.01    If  Governor  Willie   Obiano   did   not  transmit  the  written declaration   as   it  is  evident  that   he  failed  to   do   before proceeding on vacation in January 2017, did the erudite Hon. Chugbo Enwezor, and the Anambra State House of Assembly carry   out   their   constitutional   legislative   responsibility   by mandating the Deputy Governor, His Excellency, Dr. Nkem Okeke, to perform the functions of the office of the Governor as the Acting Governor of Anambra State pending when the Governor returns from vacation?

4.02.    Did the Deputy Governor, His Excellency, Dr. Nkem Okeke, perform the functions of the office of the Governor in the capacity of Acting Governor of Anambra State during the period when Governor Willie Obiano was on vacation in January 2017?

4.03.    Is Governor Willie Obiano entitled   upon   arrival from   his vacation outside the coastlines of Nigeria, to carry out the duty of Governor of Anambra State without transmitting a letter to the Speaker of the House that he is now available to resume his functions as Governor?

4.04.    Has Governor Willie Obiano transmitted any letter to the Speaker of the House of Assembly since after his vacation stating that, he is now available to resume his functions as Governor of Anambra State?

4.05.    Has Governor Willie Obiano satisfied requirements of Section 190.(1)(2) of Constitution of the Federal Republic of Nigeria 1999 (as amended)?

5.    LOCAL GOVERNMENT ADMINISTRATION:

5.01.    It is the provision of Section 7.(1) of Constitution of the Federal Republic of Nigeria 1999 (as amended) that:- "The system of local government by democratically elected local government councils    is    under    this    Constitution    guaranteed;    and accordingly, the Government of every state shall subject to section 8 of this Constitution, ensure their existence under a Law   which   provides   for   the   establishment,   structure, composition, finance and functions of such councils."

5.02.    Section 7.(4): "The Government of a State shall ensure that every person who is entitled to vote or be voted for at an election to a House of Assembly shall have the right to vote or be voted for at an election to a local government council."

6.    It is the provisions of Section 54 of the Local Government Law of Anambra State 1999 (as amended), that: "Every ward, in a local area shall have a democratically elected Councillor representing it in the council."

6.01.    Similarly, it is the provisions  of Section  59  of the  Local Government Law of Anambra State 1999 (as amended), that: "Each local government area shall have a democratically elected Chairman and Vice-chairman."

6.02.    It is also the provisions of Section 64 of the Local Government Law of Anambra State 1999 (as amended), that:-

6.03.    Section 64. (1): "The Electoral Commission shall appoint a date for election into the offices of the Chairman arid members of the local government council.”
6.04.    Section 64.(2): "The election referred to in subsection (1) of this section shall hold not earlier than ninety days and not later than sixty days before the expiration of the terms of offices of the last holders of those offices."

6.05.    The terms of offices of the last holders of the offices of Councillor and Chairman and Vice-Chairman in the 21 local government council areas in Anambra State, expired in January 2016.

7.    QUESTIONS:

7.01.    Is the plans being hatched by the Governor Willie Obiano led Government of Anambra State to appoint transition/caretaker committees and/or liaison officers, to manage the affairs including finances of the 21 local government councils in Anambra State, not contrary to Constitution of the Federal Republic of Nigeria 1999 (as amended), and, the Local Government Law of Anambra State 1999 (as amended), respectively?

8 THREATS TO KILL:

8.01.    In   a telephone   conversation   at about   8pm   on   Thursday February   23,   2017, the   Governor of Anambra   State,   His Excellency Chief Willie Obiano, personally, and by himself, threatened to kill me if I fail to stop questioning the unlawful activities of his administration. Please refer to my letter to His Excellency the Governor of Anambra State, dated February 24, 2017.

8.02.    It is the provision of Chapter IV, Section 33.(1) of Constitution of the Federal Republic of Nigeria 1999 (as amended) that: "Every person has a right to life, and no one shall be deprived intentionally of his life save in execution of the sentence of a court in respect of a criminal offence of which he has been found guilty in Nigeria”
8.03.     It is   also the   provision of Chapter IV, Section   39.(t.) of Constitution   of the   Federal   Republic  of  Nigeria   199?   (as amended) that: "Every person shall be entitled to freedom of expression including freedom to hold opinions and to receive and impart ideas and information without interference."

8.04.    For the avoidance of doubt, and for ease of reference, please permit me Your Excellency, to reproduce in part herein below Oath of Allegiance and Oath of Office of Governor of a State, as contained in the SEVENTH SCHEDULE of Constitution of the Federal     Republic     of     Nigeria     1999     (as     amended)
“I……………………. do solemnly swear/affirm that I will be  faithfully and bear true allegiance to the Federal Republic of Nigeria and that I will preserve, protect, and defend the Constitution of the  Federal  Republic  of Nigeria.   So help me God.”
“ ………………….. that I will not allow my personal interest to influence my official conduct or my official decisions; that I will be best of ability preserve, protect, and defend the Constitution of the Federal Republic of Nigeria, that I will abide by the Code of Conduct contained in the Fifth Schedule to the Constitution of the Federal Republic of Nigeria; that in all circumstances, I will do right to all manner of people according to law, without fear or favour,  affection on ill will......"


8.05.    This     threat     by     the     Governor     of     Anambra     ST,i:e, Maduaburochukwu Obiano, to kill a citizen because the citizen exercised his freedom of expression including fre to   hold   opinions  and   to   receive   and   impart   ideas  an information, is it in consonant with the Oath of Allegiance and Oath of Office subscribed to by Your Excellency?
9    ABUSE OF POWERS:

9.01.    It is the provision of the FIFTH SCHEDULE to the Constitution of the Federal Republic of Nigeria 1999 (as amended) @ Section 9 that: "A public officer shall not do or direct to be done, in abuse of his office, any arbitrary act prejudicial to the rights of any other person knowing that such act is unlawful...."

From the totality of the above, would it not be right for me to undertake that I have acquired the requisite locus standi to blow the whistle regarding the activities of the Governor of Anambra State, His Excellency, Chief Willie Maduaburochukwu Obiano, which in my own opinion, amounts to breach and grave violation of the Constitution of the Federal Republic of Nigeria 1999 (as amended)?

Consequent upon the above, would it not be right for me to also undertake that I am not a busy body or meddlesome interloper as alleged, rather, that i have acquired vested legal rights worthy of protection regarding our petitions against the activities of His Excellency, the Akpokuedike Aguleri, Chief Willie Maduaburochukwu Obiano, which in my own opinion amounts to abuse of powers, and abuse of Oath of Office, and Oath of Allegiance of Governor of Anambra State, by Governor Chief Willie Obiano?
